Terms and Conditions

One of Old Soul Revival’s (OSR’s) main priorities is customer satisfaction. We ask that our customers read our Terms of Service thoroughly as the information below pertains to all services, products, and information offered by OSR. By engaging with OSR through our website or other portals (phone, email, or in person) you are agreeing to the terms and conditions outlined below.

Our terms and conditions are based on, and inclusive of, the guarantees offered to consumers outlined by the Australian Comptetition & Consumer Commission (ACCC).

Items sold by OSR are guaranteed, under Australian consumer law, to be:
• sold in acceptable quality as a pre-owned item;
• fit for purpose, or, otherwise disclosed;
• corresponds to the photographs and description provided;
• are sold by Old Soul Revival.

GENERAL

Items offered for sale are described to the best of our abilities, and are sold as is, where is. With years working in the art and antiques trade, we have a pretty good idea of what we have, but all information is to be regarded purely as opinion unless explicitly stated otherwise. We encourage buyers to do their own research prior to purchase. We strive to describe all aspects of the objects as best and accurately as possible, but should you have any concerns, we welcome second opinions.
All items offered by OSR are second hand; most are antique; and all have character. A consequence of this state is that items may have signs of wear including but not limited to scratches, chips, dents, or knocks. Antique locks, for example, are particularly finicky, so may not always work perfectly and items containing these must always be transported with this in mind.
Objects sold by OSR are described and priced according to condition, with photographs identifying any faults. If you have any concerns, please contact us and we will be more than happy to send you more photographs, or provide more information.
We offer an in-house restoration and repair service and on occasion items will be offered for sale in ‘as found’ condition with this as an option. On such occasions, objects will be sold as ‘unrestored’, with the purchaser having the option to employ our services for any work that is required. The cost of these repairs or restorations is subject to negotiation with OSR.
Styling objects, such as vases and other objects placed on furniture to show how they can be styled do not come with objects that are being offered unless explicitly stated otherwise. If you see something you like in one of the photos that isn’t listed on our website, please be in touch, as we are always open to offers.
In some listings, historical context is provided. This is as accurate as we have been able to make it at the time of publication, however we make no guarantees regarding its accuracy, nor do we necessarily have the resources to ensure all facts are up-to-date. It is the customer’s responsibility to do their own research regarding accuracy.
We strive to photograph objects to the best of our ability. Sometimes colours appear slightly different in different light, or on different monitors/digital devices. We encourage viewing in person to ensure you are satisfied with the colours of the items(s) you wish to purchase. Should you commit to purchase without viewing in person, we claim no responsibility for colours appearing different in different lights or in person compared to on a monitor/digital device.
Unless explicitly stated otherwise, objects, services, and information are provided without warranty and are to be regarded as sold ‘as is, where is’.


SALES AND PAYMENTS

All prices are in Australian Dollars ($ AUD).
All sales are final, made in good faith, and subject to the laws of the Australian Capital Territory.

By committing to purchase either verbally or in writing through one of our commerce platforms (ie. shopify, ebay, or any other entity tied to Old Soul Revival) or making payment, the buyer is assumed to have read and accepted these terms and conditions, as well any others specified either on the listing or by our staff at the time of purchase. All purchases are to be paid upfront within fourty-eight (48) hours of commitment to purchase unless otherwise stated.

On select items, OSR offers a non-refundable ‘holding deposit’ for products and services. This service is to be offered at the discretion of OSR and is to pre-arranged by OSR with the customer per item. The time-frame for this service is one (1) week from the date of deposit which is to be paid within twenty-four (24) hours of receiving an updated invoice. If the remaining balance is not paid within the one (1) week period agreed upon, the deposit is forfeited, and the item is relisted for sale. The exact amount of the deposit is assessed on a case-by-case basis, must be in writing, and must have written approval from one of OSR’s owners.



REMOVAL AND STORAGE

All items must be collected either by the purchaser, or a nominated agent, within one (1) week of the balance of payment. Any alternate arrangements must be made with the written approval of OSR. If not collected after two (2) weeks from the purchase date, the purchase will be considered forfeited and relisted for sale, with a refund issued to the purchaser of the sale price minus a $50 cancellation fee.

In circumstances where an item must be held in storage, storage fees beyond one (1) week will be at the discretion of the business owners based on the dimensions of the piece, with the cost charged at a daily rate and to be paid by the customer at the end of the nominated storage period. This is subject to item being paid for in full before a storage period can commence.

If items kept in storage exceed this storage period without the storage arrangement being extended, or the storage fee unpaid, will be considered as a breach of contract with the buyer forfeiting the item, with the item being relisted for sale, minus storage fees and a $150 cancellation fee.

Removal and collections are the responsibility of the purchaser to arrange. OSR offers removal services as outlined on our ‘Shipping’ web page and are happy to assist moving furniture and other items at cost, or recommend alternative services. Once an item has been given to the purchaser or shipping agent, OSR relinquishes all responsibility for the condition of the object upon arrival.




PRIVACY POLICY

This website (‘Old Soul Revival’), all images, graphics, and photography, information including descriptions and blogs, and intellectual property are all owned by OSR.
Images, descriptions, and other material of items that are, and formerly were, may still be used by OSR for future promotional purposes.
All information collected on this website is used at OSR’s discretion in a fair and equitable manner.
Any images, information, or other content may not be used by another party unless with express permission of one or more owning parties of OSR.

STORAGE OF PERSONAL INFORMATION

Any information given to OSR in the course of sales is stored securely through the Shopify e-commerce platform.
Any personal information collected by OSR is kept private and is not shared to anyone or any related entities without your prior approval (such as providing a courier with your address for delivery).

Information is solely used by us for billing purposes, however we reserve the right to contact you for future promotional purposes. You may opt out of these at any point in time.


EMPLOYMENT OF PROFESSIONAL SERVICES

OSR guarantees all work as set out in individual quotes for restoration, repair, or delivery services explicitly undertaken by OSR. It does not guarantee the work of contractors that it may recommend, however, these are only recommended to customers based on years of personal experience.
All terms in previous sections regarding the sale of items that may also be applicable to professional services offered by OSR are also applicable.
Any additions or amendments to the services stated in the initial quote that are requested by the client must be recorded in writing, and a new quote will be issued by OSR.
At the point of any changes being made by the client, work will be stopped and only restarted when a new quote is agreed upon.
The client is financially responsible for any work that may have already been completed to that point and items will be kept as collateral for this payment. Should payment not be completed, the client has two weeks to collect the item (or more subject only to written agreement from one of OSR’s owners), after which the item will be deemed as forfeited. On forfeiture, ownership of the item(s) will be transferred to OSR who may sell or restore as they see fit. It is up to the sole discretion of OSR’s owners whether or not proceeds beyond the cost of labour and administration for the sale/restoration to saleable condition of the object is returned to the original client.
Should new changes not be agreed upon, the client will collect the items in whatever state it is presently in. This may include being in a state of disassembly or part-way through a restoration/repair process.
Any changes to services will naturally slow the process and any agreed upon dates for completion will likely need to be revised.

Tangible aspects of items such as how soft or comfortable an item is may change after restoration. OSR endeavours to meet everyone’s preferences, but aspects such as ‘sit quality’ can not always be guaranteed. The client assumes this risk by engaging OSR’s services.
Any further work after completion of services will be charged at our hourly rate.
Furniture is expected to be dropped off in a reasonable state of cleanliness. Unexpected cleaning costs may be added to any quote at the discretion of OSR.
All quotes are based on plain-designed, and readily available fabric. Additional time is often required for sourcing specialty fabrics and quotes may include this.
We endeavour to use original hardware. Sometimes this is simply not possible. With the nature of working with second-hand furniture, there are rare occasions where unexpected issues arise such as hardware failure. On such occasions, OSR will immediately contact the client to discuss options and either a new quote will be issued, or the client will pay for work already completed and collect the item in whatever state or repair it is in.
All quotes are valid for 30 days.
A 50% deposit of the quoted price is required for the commencement of services.
Items for repair or restoration must only be dropped off with OSR on approval of OSR.


COLLECTION

On completion of services, clients will be contacted within twenty-four (24) to fourty-eight (48) hours of completion either via phone or email. From the notification of completion of services the client has seven (7) days to arrange to, or collect themselves, the item(s).

Failure to collect items results in the same penalties and storage costs as outlined above for items purchased from OSR.


WARRANTY

All work completed by OSR has a 12-month guarantee and is exclusive of pre-existing wear, tear, and use found in second hand items which is to be expected on all items unless otherwise stated.

The warranty will be void if:

• The client misuses the product;
• The client or their agent alters the product in way; or,
• Damage is the result of an old structural fault (as will be explicitly identified by OSR staff at the time of quote and/or completion of services).
